The formula
- Holder: 200% of the SMI per month.
- Household of two (holder + one family member): add 75% of the SMI.
- Each person beyond two: add 25% of the SMI.
Reading A uses the monthly SMI as published (1.221 EUR). Reading B uses the annual SMI (1.221 x 14 = 17.094 EUR) divided by 12 (1.424,50 EUR). The text of the instruction says only "monthly", so both readings circulate.
Sources
- Rule: Joint instruction of 30 March 2023 (published by the Spanish consulate in Moscow), instruction third, 1.
- SMI: Real Decreto 126/2026, art. 1 (BOE no. 44, 19 Feb 2026).
- Reading A in practice: SMI table, Spanish consulate in Hanoi (from 19/02/2026) shows 2.442 / 915,75 / 305,25.
- Law behind it: Ley 28/2022, new Chapter V bis (arts. 74 bis to 74 quinquies of Ley 14/2013). Disposition 20 says amounts are referenced to the SMI.
What is not confirmed
- Which reading your consulate uses. Consulates publish their own tables; one older consular table (Santiago de Chile, 2023) cites the annual SMI, another (Bahia Blanca) a monthly figure.
- Whether the 2023 joint instruction has been replaced since the 2024 Reglamento. The Reglamento text we checked does not mention teleworkers, and the 2026 Hanoi table still follows these percentages.
